Kim Zolciak Son KJ Biermann Pleads Not Guilty to Felonies

Kroy “KJ” Biermann Jr., the 15-year-old son of reality television personality Kim Zolciak, has entered a formal plea of not guilty to seven felony charges. The charges stem from an alleged incident with a female classmate in Alpharetta, Georgia. Defense attorney Don Sheffield informed the judge of the plea while waiving a scheduled October 14 arraignment in Fulton County Superior Court.

The defense formally requested that the court consider transferring the case to juvenile court before establishing pretrial and trial dates in superior court. Sheffield emphasized that Biermann was 14 years old at the time of the alleged April 23 encounter at a Life Time Fitness location. The defense argues that a youth-focused rehabilitation system is appropriate. They note that an adult-court conviction on the primary counts carries a mandatory minimum sentence of 25 years without parole.

Details of the Charges and Indictment

Biermann was initially arrested in August on charges of aggravated sodomy and aggravated s*xual battery. A Fulton County grand jury subsequently expanded the case to a seven-count indictment on September 3. The indictment includes:

  • Aggravated child
  • Aggravated s*xual battery
  • Aggravated sodomy
  • False imprisonment
  • Three counts of s*xual battery against a child under the age of 16

Biermann spent more than a month in juvenile detention before Fulton County Superior Court Judge Melynee Leftridge granted him a $200,000 bond during a September 11 hearing. The court imposed strict conditions on his release. He must live with his mother, attend school virtually, wear an electronic monitor, surrender his passport, and abstain from cellphone and social media use. He is also barred from contacting the alleged victim, her family, and anyone aged 16 or younger.

Addressing Prior Juvenile Matters

During bond proceedings, prosecutors raised concerns regarding an earlier juvenile matter from October 2025 involving material recovered from Biermann’s phone concerning an underage family member. Prosecutor Caitlin McGillicuddy cited this history while arguing against his release.

“The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case,” stated defense attorney Jason Sheffield.

Sheffield clarified that the prior matter involved crude behavior between two middle-school-aged children. It did not result in an adjudication for statutory , s*xual intercourse, or any comparable offense. That matter remains entirely separate from the active felony proceedings in Superior Court.

Next Steps in the Legal Process

With the formal not-guilty plea entered and the arraignment waived, the immediate focus centers on Judge Leftridge’s decision regarding the defense’s motion to transfer the prosecution to the Fulton County Juvenile Court. Prosecutors have also requested permission to conduct forensic interviews with additional minors as part of the ongoing investigation. Biermann remains free on bond while the legal proceedings continue.
