Monterey County Charges Mother in Baby Angelita Case

Monterey County prosecutors charged 36-year-old Ofelia Garcia Ortega on October 7 after her 14-year-old daughter was safely recovered in Mexico alongside the girl’s biological father, Sergio Galvez Perez. The high-profile investigation is directly tied to the tragic death of the teenager’s premature newborn, who was discovered dead near Moss Landing on August 1.

Garcia Ortega was arrested without incident on Tuesday afternoon at the Monterey County Superior Courthouse by sheriff’s detectives. She faces two felony counts of displaying or possessing a forged identification card, along with misdemeanor counts of permitting a child to suffer or be endangered and contributing to the delinquency of a minor, according to the Monterey County District Attorney’s Office.

Allegations of Child Endangerment and Falsified Labor

According to investigators, Garcia Ortega allegedly allowed her daughter to work in agricultural fields at the age of 13 using falsified documentation. Authorities also state that the mother permitted the teenager to drive without a license and kept her completely out of school for many months.

"For many months on end, she was causing her daughter to work in the fields using false documentation," said Assistant District Attorney Lana Nassoura during briefings on the case. "This 13-year-old child, who should have been in middle school, was actually out of school for many months… She was driving a vehicle without proper licensing."

Garcia Ortega is currently being held at the Monterey County Jail on a $150,000 bail. Her initial court appearance took place briefly on Wednesday, but her formal arraignment was delayed until Thursday to allow her to obtain a specialized Spanish interpreter from her native region of Mexico.

Connection to the Baby Angelita Investigation

The broader criminal investigation began on the morning of August 1, when emergency responders were called to the 100 block of Struve Road, north of Moss Landing. Investigators discovered a deceased premature newborn girl, whom authorities and the community referred to as "Baby Angelita."

Post-mortem examinations indicated that the infant suffered traumatic injuries after the 14-year-old mother delivered the baby beside the rural road and left her. While law enforcement initially scrutinized the teenager as a suspect in the infant’s death, prosecutors have emphasized that no criminal charges regarding the homicide have been filed against the minor. Officials have repeatedly acknowledged the teenager as a victim of severe abuse.

Arrest of Sergio Galvez Perez in Mexico

The teenager’s father and husband to Garcia Ortega, 38-year-old Sergio Galvez Perez, was apprehended by law enforcement over the weekend in the Mexican state of Chihuahua. Mexican authorities carried out the rescue operation that located the 14-year-old girl and arrested Perez after finding him in possession of narcotics.

Perez faces multiple felony charges in Monterey County Superior Court, including committing a lewd act upon a child younger than 14 resulting in great bodily injury, incest, and child abuse. Investigators previously identified Perez as the biological father of both the teenager and the deceased newborn.

The teenager is currently safe and receiving specialized care through child protective services in Mexico. Federal, state, and international law enforcement agencies, including the FBI and Mexican authorities, collaborated closely with the Monterey County Sheriff’s Office to execute the rescue operation.

Legal Proceedings Moving Forward

Authorities note that Garcia Ortega was previously arrested on August 4 on suspicion of felony child endangerment before being briefly released on bail. It remains undetermined whether prosecutors will consolidate those earlier allegations with the newly filed identification and child welfare charges.

The Monterey County Sheriff’s Office and the District Attorney’s Office continue to examine all aspects of the case as extradition proceedings and local court hearings move forward. Further details regarding the investigation are expected to be addressed during scheduled law enforcement briefings.
