Details of the Alleged Incident
In the court filing, Martinez claims the conflict began when Berry criticized their son. She allegedly called him “so stupid” and an “idiot” while he was using virtual reality goggles. The situation reportedly escalated rapidly.
“The situation escalated and Petitioner jumped on our son and started physically fighting with him,” Martinez alleged in the documents. “She grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now?! Who is dominant?!'”
Martinez further claimed that the September 26 event was not an isolated occurrence. He stated in the filing that over the past year and a half, Berry allegedly wrestled Maceo to the ground and forced him to “tap out.” He also expressed deep concerns regarding her mental health and alleged alcohol abuse, which he believes contributed to the aggressive behavior.
Halle Berry’s Legal Response
Halle Berry’s attorney, Marina Beck, forcefully denied the allegations in a statement to media outlets. She characterized the legal filing as a retaliatory and misleading maneuver.
“To say this filing is entirely meritless and deliberately misleading would be an understatement,” Beck said in the statement. “There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo – misconduct for which Mr. Martinez has already been legally sanctioned.”
Beck’s statement added that Martinez has a “well-documented history of erratic, possessive and violent behavior.” She assured the public that Berry remains committed to fighting for her son’s well-being.
Custody and Visitation Restrictions
Under the terms of the temporary emergency order granted by the court:
- Berry must maintain a distance of at least 100 yards from Martinez.
- In-person visitation with Maceo is temporarily limited to supervised or structured visits twice a week and on alternating weekends.
- Martinez has formally requested sole legal and physical custody of the 12-year-old boy.
- Further evaluations and arguments from both legal teams are expected at the upcoming October 16 court hearing.
Berry and Martinez married in 2013 and finalized their divorce in 2015. Berry’s legal representatives have indicated they will contest the custody modification request entirely when the case returns to court.
